On Wednesday January 4th, 2006 at the tender age of 12 years old, Djinn was arrested and charged with the offenses of Criminal Homicide, One Count of Arson, Six Counts of Aggravated Assault and Six Counts of Reckless Endangerment.
On the same date January 4th, 2006 the questioning of Djinn Oakstar Rayn Buckingham took place at the Children and Youth services in Monroe County, Pa. by the State Police of Lehighton. We feel that Djinn Buckingham's legal rights were violated when at 12 years old he supposedly gave a life altering confession. There is no tape and or recording of this confession. Djinn did not have presence of counsel during this questioning session. Djinn's mother was in Arizona burying Sierra, her neice and Djinn's cousin who died in the fire. The questioning was only to be allowed if the case worker was present during Djinn's questioning and she was not.
In a Supreme Court decision the 1967 Gault case, the court ruled in regards to Juveniles (1) "No statement made by the Juvenile can be used in a proceeding against them unless a determination has been made on the record that the Juvenile knew he was not obliged to speak and would suffer no penalty for being silent." There is no record of such determination.
Also "if counsel was not present for some permissable reason when an admission was obtained, the greatest care must be taken to assure that the admission was voluntary, In the sense not only that it was not coerced or suggested, but also that it was not a product of adolescent fantasy, fright or despair." Since this confession was not taped or recorded how do we know that the confession was voluntary and was not coersed,suggested, or a product of imagination?
Juveniles face two major issues as it pertains to interrogations. First does a juvenile have the capacity to inderstand their fifth-amendment right against self-incrimination as it is explained to them in the Miranda Rights Warning? Susceptibility to suggestion coupled with inherent naiveities and immature thought processes raise serious doubts as to the Juvenile to understand their rights. Another concern is assuming that the child understands their rights, will they successfully invoke them when all alone in a small interrogation room with adults posing pointed, accusing questions at them. Even if a Juvenile does understand their Miranda Rights and gives a statement that is considered, "knowing, intelligent and voluntary" it may not be reliable because of the nature of Juveniles to be incapable of adult reasoning.
We state two appropriate cases for the record as to the unreliability of "Juvenile Confessions".
(1) The case of Michael Crowe
(2) The case of Ryan Harris
We find that Djinn Oakstar Rayn Buckingham being incarcerated for a crime he did not commit to be cruel and unusual punishment, coupled with the above findings we feel that Djinn Oakstar Rayn Buckingham has suffered enough and poses no threat to himself or society. We humbly place this petition before you this day, to respectfully beg of you the following.
(1) For Mercy upon Djinn Oakstar Rayn Buckingham
(2) For a full pardon from the Commonwealth of Pennsylvania.
(3) For the immediate release of Djinn Oakstar Rayn Buckingham
(4) If none of the above criteria can be met, we request that the Case of Djinn Oakster Rayn Buckingham be reopened and all new information gathered can be presented, in a court of law.

Djinn's Attorney Fees Fund
This is an uphill battle, I know-but it is a battle that I do not intend to lose. We need your help and support now desperately. Please I am asking you to please don't turn away from Djinn. Your dollars can help us get to the goal-as I stated we need to raise about $2800 in a month. I have put my money where my mouth is, I believe in Djinn, I am praying you do to and are willing to help us. We have found so much evidence which shows Djinn didn't do this.....This is a war we can't lose, please help by contributing.
I need to talk to each one of you reading this about standing up and doing what you feel in your heart is the right thing to do. I also feel the need to talk to everyone about letting go, about having the guts to let everything go and trust & believe in yourself and others. Many people talk but when it's their time, they lose their guts, back down, and won't let it go. It's time to have compassion for our fellow neighbors and help the hurting to heal. I am an advocate trying to change the system and to make things more favorable for children caught up in the justice system. I am very proud to say that I am deeply involved in the Djinn Buckingham case. Many people have never taken the time to get to know Djinn. Djinn Buckingham is undeserving of the wrath and unkind words told upon him by the public and media bothl. Djinn Buckingham was arrested and confessed at the age of 12, to the crimes of arson & murder. Djinn stated after his arrest, that he did not set the fire-and held firm to that until his adjudication in July of 2006 when he said in a very soft voice, when asked by the presiding Judge if he would like to admit to the charges and said "yes sir". Now to fully understand this think about it-Djinn was sent to a juvenile detention center 2 months before this adjudication, he was not allowed any visitation by any family member or friend during this 2 month period-a very vulnerable time for Djinn-the only things Djinn was hearing were words from Psychiatrists and Doctors, telling him he needed to plea out and get with the program as he would not see or be with his mother again,plus Djinn loved Sierra-his cousin who died in the fire. They were insepersble-Djinn was very protective of Sierra and it broke his heart when she died in the fire-Djinn tried to get to her, but was overcome with smoke and had to get the others out of the house. You cannot tell me that did not devastate him and force him into pleading guilty when he really wasn't
Twice since that adjudication and placement in the Cornell Abraxas Youth Center, Djinn has again stated that he did not set the fire and that he was minipulated and forced into confessing and pleading guilty to crimes he did not commit.
Now, you don't have to take my word for it but false confessions happen all the time and Djinn's false confession is not an isolated incident. Please look online and you will see what I am talking about. Those of you who are parents know and understand how vulnerable some children are and how susceptable some kids are to pleasing an authority figure, no matter what the case or circumstances are. Please understand that Djinn was learning disabled-in order for Djinn to understand you, he had to see what you were talking about with his own eyes-he had to see things with those eyes to understand you and if you took the time with him to do that he would do it better than you ever could, but if you just told Djinn what to do and didn't explain it to him to where he could see it with his own eyes, he would get mad at you, shut down and go to sleep. Now think about it-how can a child with this background understand things when he was being questioned by police and the fire marshall? He just told them what they wanted to hear so they would leave him alone. This questioning lasted for three hours before Djinn confessed-the poor kid was scared, tired and just wanted to get them off his back.
Now getting back to the matter at hand-since being placed at Cornell Abraxas, Djinn has been sexually molested by another inmate-to our understanding the guards stood by and never tried to stop the incident until it was over. Djinn has also been injured at least three times by restraining procedures that guards and staff employ. Djinn has been through so much since his incarceration and it's time the public knew about it-so we can stop it from happening again to Djinn and any other inmate forced into the system.
. We are so close to proving Djinn's innocence and to be unable to get the opportunity to prove that would be a tragic circumstance and all of us will lose-the biggest loser in this would be Djinn. I am drawing a line in the sand right here , right now. If we don't help Djinn now-then this world will be a much sadder place, as a precious beautiful soul would have been deeply wounded and will die. I am not willing to let that happen, I will not let another child that is innocent, knowing he is innocent, spend another day incarcerated for something he did not do. I will also not let a corrupt Children and Youth services run roughshot over him. Please help us pay-off an attorney, we have one month .
Stand with me. We need to raise about $3000 in a month to pay-off the attorney. I am asking you to please contribute now as this is a child worthy of help. Djinn needs us-don't turn away from him.
